For this week, although there is the usual reporting of abuse, there are a significant number of articles with good news!  


I had to create a new category for “Weirdities in the News” or a Variety section….good and not so good. I also included a section for abuse cases involving schools:



In two articles covering the Disability and Abuse/Disability and Guardianship Projects’ work, news articles described the U.S. Department of Justice complaint we filed regarding the practice of L.A. Superior Court to remove the right to vote of proposed conservatees appearing before them. Without a proper showing of evidence that the individual is not able to vote, the court should not rule against them.  The USDOJ responded by not only calling for an investigation in the Los Angeles court, but expanded the investigation to all 58 counties.  We are very excited!!! The second article features the young man whose expressed desire to vote brought the issue to our attention. Although over 50 papers nationally covered the news, please see articles # 2 and 6 for coverage.  Both Tom Coleman and I (Nora Baladerian) are quoted.  Let us know your thoughts!!


Additionally, article #78 covers likely passage of SB 589 here in California that requires that proposed conservatees be presumed competent to vote, and only when clear and convincing evidence of inability even with reasonable accommodation has been presented may a judge remove that right.  It is likely the bill will pass next week and be signed by the Governor. 


Article #38 describes a settlement in New Mexico of a lawsuit alleging violation of the waiver system which resulted in massive denials of needed services to thousands of individuals with disabilities.


Article #61 describes an investigation in VA that reveals system failures in reporting abuse and highlights the importance of investigation proposed conservators due to high levels of abuse of individuals with disabilities.


Article #74 describes a bill in Texas to install videocameras in classrooms and isolation rooms for special education students.


Article #79 describes HB5 that authorizes clerks in guardianship proceedings to refer cases of wrongdoing for criminal prosecution.

#9 - California County Probation Department, in a settlement, will no longer be allowed to place juveniles with disabilities in solitary confinement, which was one for up to 23 hours per day, for days on end.

#22 - After being found guilty of pushing a man using a wheelchair out of his wheelchair, police officer is demoted.

#26 - The division of licensing in Michigan failed to report to APS 25% of cases of suspected abuse.

#51 - In Pennsylvania, a lawsuit is pending to allow felons to provide care to vulnerable elders. What? “Give them a chance."

#58 - The mother of a student with disabilities finds all special education students photos are not in school yearbook. Why?

#102 - In the UK a research project on sexual abuse of adults with disabilities was conducted, finding, among other things, that 63% of the victims had learning disabilities (British for intellectual and developmental disabilities) and 37% had physical disabilities.
